Privacy Policy

In Home Care Technology (IHCT) distributers of the Chuffty App is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

We also adhere to the extent applicable, to the EU General Data Protection Regulation (GDPR).

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our websites www.ihct.com.au & www.chuffty.com.au , from your website, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us via email or in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Cookies - From time to time we may use "cookies" (small files websites use to identify visitors when they make a return visit to that website). Cookies are not malicious programs which access or damage your computer or device. You can configure your browser to reject or delete cookies. Any cookies we use are used to only analyse web traffic for improvement to the website, our cookies may or may not link to Google AdWords for further traffic analysis.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual’s racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Sensitive information will be used by us only:

  • For the primary purpose for which it was obtained
  • For a secondary purpose that is directly related to the primary purpose
  • With your consent; or where required or authorised by law.

If you withhold Personal Information this may impact our ability to provide our services to you or not allow full access those services.

Third Parties

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
In Home care technology (and chuffty.com.au) do not share your personal information with any other 3rd Parties except for the purposes of financial transactions pertaining to any payments or subscriptions you arrange, in such cases the 3rd Party could be a Bank or Financial Processing Agent such as PayPal, Stripe or similar.

  • Where required or authorised by law.

General Data Protection Regulation (GDPR) for the European Union (EU)

  • In Home Care Technology (and chuffty.com.au) will comply with the principles of data protection set out in the GDPR for the purposes of fairness, transparency and lawful data collection and use.
  • We process your personal information as a Processor and/or to the extent that we are a controller as defined by GDPR.
  • We establish a lawful basis for processing your personal information. The legal basis for which we collect your personal information depends on the data we collect and how we use it.
  • We will only collect your personal information with your express consent for a specific purpose and any collected data will be to the extent necessary and not excessive for its purpose. We will keep your data sage and secure.
  • We will also process your personal information if it is necessary for our legitimate interests, or to fulfil a contractual or legal obligation.
  • We process your personal information if it is necessary to protect your life or in a medical situation, it is necessary to carry out a public function, a task of national interest or is the function has a clear basis in law.
  • We do not collect or process any information from you that is considered "Sensitive Personal Information" under GDPR, such as personal information relating to your sexual orientation or ethnic origin unless we have obtained your explicit consent, or if it is being collected subject to and in accordance with GDPR.
  • You must not provide us with your personal information if you are under the age of 16 without the consent of your parent or someone who has parental authority for you. We do not knowingly collect or process the personal information of children.

Your Rights Under GDPR

(A) If you are an individual residing in the EU, you have certain rights as to how your personal information is obtained and used. In Home Care Technology (and chuffty.com.au) complies with your rights under GDPR as to how your personal information is used and controlled if you are an individual residing in the EU.
(B) Except as otherwise provided in the GDPR, you have the following rights:

  • to be informed as to how your personal information is being used
  • access your personal information (we will provide you a free copy of it);
  • to correct your personal information is it is inaccurate or incomplete;
  • to delete your personal information (also known as "the right to be forgotten");
  • to restrict processing of your personal information
  • to retain and reuse your personal information for your own purposes;
  • to object to your personal information being used; and
  • to object against automated decision making and profiling.

  • We may ask you to verify your identity before acting on any of your requests.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a maximum of 5 years as required by local Australian Tax Law for financial regulation.

Hosting And International Data Transfers

  • Information we collect may from time to time be stored, processed or transferred between parties or sites located outside of Australia for the purposes of web hosting, data storage, data security and or data backup.
  • Transfers of data will be protected by appropriate safeguards, these include one or more of the following: the use of standard data prtection clauses adopted or approved by the European Commission which you can obtain from the European Commission website; the use of binding corporate rules which may be obtained from In Home Care Technology (or chuffty.com.au) Data protection Officer.
  • Our suppliers and contractors are situated in Australia.
  • You acknowledge that personal data you submit for publication through our website, mobile apps or email or via any of our services maybe be available, via the internet, around the world. We cannot prevent the use (or misuse) of such personal data by others.
  • We may employ data processors to process personal information on our behalf, we only do so on the basis that such processors comply with the requirements under the GDPR and that have adequate technical measures in place to protect personal information against unauthorised use, loss and theft.
  • The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

General Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us via email (enquiries@ihct.com.au) or in writing using the contact details contain in this Privacy policy.

In Home Care Technology (and chuffty.com.au) will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

We do not share or sell any of your data, and only use it for the purposes it was collected for.
You may request to have some or all of the data we have about you and your App usage deleted.

  • The email request must be sent from the email account of the account holder.
  • Your email must include the ACCOUNT ID associated with the account holder.
  • An email reply confirmation from the original account holder will be required before data deletion is executed.
